1998 FCRA Admendment

The latest amendment to the Fair Credit Reporting Act was signed into law in November of 1998, and is referred to as the Consumer Reporting Employment Clarification Act of 1998. Please note the following changes in that Act that will have a direct effect on what Creative Human Resource Management Inc. will and will not be able to report in the future. Under the latest amendment, 605(a)(5) has been deleted altogether, and replaced by the following rules:

(A) Civil suits, civil judgments, records of arrest, paid tax liens, bad debts and any other adverse item of information, except criminal convictions may only be reported for seven (7) years, ten (10) years for bankruptcy.

(B) "Records of convictions of crimes" are exempted from the seven (7) year rule. Consumer reports on individuals expected to earn more than $75,000.00 per year continue to be exempt from all the time limitations.

CHRM will continue to report all information found on record for 7 years, however, will only report felonies and misdemeanors older than 7 years in states allowing such to remain in compliance with the Fair Credit Reporting Act.
